At Clarity Law, our services are primarily billed at a flat fee. Clients will be advised if additional fees might be incurred. We feel it is important to take the time to ensure that all questions are answered and there are no unexpected surprises when it comes to billing.

You want to know the cost before you commit, and I always like to be upfront with clients about fees for estate planning. After providing some information about what you want to achieve in the estate planning process, I can provide a detailed quote.

Estate Administration

There are specific rules regarding how much lawyers can charge for preparing these types of court applications. Fees for preparing a straightforward application with no wrinkles or additional issues that need to be addressed are based on the value of the estate property.

Fees are calculated as follows:

$1,500.00 plus

1% on the first $500,000.00 of the value of the estate;
0.75% on the next $500,000.00 of the value of the estate; and
0.5% on the remaining value of the estate.

This is the most that we can charge for a straightforward application.

If there are additional issues that need to be addressed, additional fees could apply.

Probate Fees

“Probate Fees” are the fees paid to the court when an application is submitted.

Fees are 0.7% of the value of the estate
Additional $200.00 court levy
$25.00 Additional Certificate for real property that the deceased owned solely in their name and no children who are beneficiaries
All of these fees must be submitted with the application when it is submitted to the court.

Both legal fees and the court fees that need to be paid are considered valid estate expenses.

This means that these expenses can be paid with assets in the estate.

Real Estate Purchase

Dependant on the value of the property and whether or not there is a mortgage that will be registered.

Mortgage to be Registered

Purchase price is $500,000.00 or less legal fees are $900.00;
Purchase price is between $500,000.00 - $1,000,000.00 legal fees are $1,100.00; or
Purchase price above 1M to be quoted for specific transaction.

No Mortgage to be Registered

Purchase price is $400,000.00 or less legal fees are $700.00;
Purchase price is between $400,000.00 - $700,000.00 legal fees are $900.00; or
Purchase price above 1M to be quoted for specific transaction.

Additional Real Estate Purchase Costs

To be paid on your behalf during the transaction.

These disbursements are incurred regardless of the law firm or lawyer assisting with the matter.

GST is charged on disbursements

Land Transfer fees - 0.3% of the value of the property
Fee to register mortgage - $180.00
Title Searches - $12.00 per search (typically will be searched three times)*
Tax Certificate and Search - $35.00*
Title Insurance (if required by the lender, usually between $200-$300 for a policy)
Courier – approximately $30.00
Processing fee - $30.00 (some banks will send the instructions through an electronic portal and there is usually a transaction fee)
Miscellaneous Expenses - $20.00 (e.g. additional searches, wire transfer fee, fax charges, postage, etc.)

Real Estate Sale

Flat fee based on the sale price of the property

Sale price less than $500,000.00 - $700.00
Sale price $500,000.00 or more - $850.00

PST and GST are also charged on the legal fees
